Assam Police will move the Supreme Court against the Gauhati High Court’s bail orders for Amritprava Mahanta and Sandipon Garg in the Zubeen Garg death case once the courts reopen. Special DGP (CID) and SIT chief Munna Prasad Gupta confirmed the decision to ANI.

“It has been decided that we will move to the Supreme Court challenging the order of bail granted to these two accused persons,” Gupta said.

With the courts on holiday, he added, “the moment the courts reopen, we will file the appeals.” He said the trial is running on a day-to-day basis in a fast-track court, and that 134 witnesses have been examined so far.

THE TWO BAIL ORDERS

On Friday, the Gauhati High Court granted bail to Sandipon Garg, a suspended Assam Police DSP and cousin of the late singer, who had been arrested by the Special Investigation Team. A single bench of Justice Rajesh Mazumdar heard his petition. Special Public Prosecutor Ziaul Kamar said the court had not read out the full order.

On October 9, the High Court had granted bail to Amritprava Mahanta, a co-singer of Zubeen Garg, making her the first accused in the case to secure it. Kamar said the bail was granted on a bond of Rs 50,000. The SIT had arrested her in 2025 after hours of questioning, and the order followed a petition she filed before the High Court.

THE CASE SO FAR

Zubeen Garg died in Singapore on September 19, 2025, in a scuba diving accident, a day before he was due to perform at the Northeast India Festival. Shyamkanu Mahanta, who has organised the festival since 2013, was also arrested after the singer’s death. In August, the Supreme Court directed the Assam government to ensure a diligent and expeditious trial against him.

WHO WAS ZUBEEN GARG

Garg was a singer, composer, musician, actor and filmmaker who recorded songs in several languages. He became widely known outside Assam with “Ya Ali” from the 2006 Hindi film Gangster, and remained closely tied to Assamese music and culture throughout his career.
