General Terms and Conditions

This is a limited period subscription offer from Open Media Network Pvt. Ltd.(OMN), which is valid for interested subscribers in India. The offer can also be subscribed online on the website https://openthemagazine.com/

Payments for subscribing to the magazine can be made only through Credit Cards or Cheque payable at New Delhi.

Allow 4-6 weeks for processing of your subscription. Subscription would be processed only after realisation of the payments.

OMN will not be responsible for postal delays, transit losses or mutilation of the subscription form.

OMN reserves the right to terminate or extend this offer or any part thereof at any time, or to accept or reject any or all forms received at their absolute discretion without assigning any reason thereof. Information regarding such cancellation / extension / discontinuation of the offer will be notified in the subsequent issue of the magazine from the day of its decision.

By participating in this offer and sending completed forms to OMN, the participant agrees and acknowledges having read, understood and accepted all rules and regulations of this offer.

All disputes are subject to the laws of India and exclusive jurisdiction of competent courts and forums in Delhi/New Delhi only.

Refund and Cancellation Policy

Any refund arising out of cancellation of subscription shall be on a pro-rata basis equivalent to the balance value of the subscription period. Allow 3-4 weeks for refund from the day of request. All refunds shall be made through an Account Payee cheque only. For online orders, full cancellation will be allowed only if the it is cancelled within 24 hours and refund for such cancelled order will be processed within 14 days.

Delivery Policy

Please allow a delivery period of 4-6 weeks (after encashment of remittance/credit to our account). For online order booking, allow delivery period of 2 weeks. Subscription copies will be delivered by post/courier as soon as the issue is released in the market place, however Open Media Network Pvt Ltd will not be responsible for postal or courier delays. If any gift scheme is offered with the subscription, allow 8-10 weeks for the delivery of the selected gift.

Emag Subscription Terms and Conditions

These terms and conditions cover your purchase of E Magazine (EMag) of “OPEN” and you agree to be bound by these terms and conditions. Open Media Network Pvt. Ltd may use technologies to verify such compliance. E Magazine is equivalent to the print version. However we reserve the right to add or remove any content / articles for web delivery without any further notification/imitation.

Payment and Order Confirmation

Payment for Subscription fees of E Magazine (EMag) of “OPEN” must be paid in full before we confirm subscription order/s. Successful payment will be given an electronic successful transaction advice that shall serve as an order confirmation. In the event that a subscription was confirmed when there has been no payment yet, for any reason whatsoever, we reserve the right to cancel your EMag account and access immediately. No request for cancellation of subscription will be entertained once your payment has been processed. Further, we reserve the right to cancel subscription in the exercise of our reasonable discretion, if we determine that payments made to us were done fraudulently or unlawfully.

Delivery Online

Upon order confirmation, your EMag link and access details/information will be delivered automatically via email. If for some reason, you do not receive your link within 24 hrs from purchase, please contact us immediately.

Accessibility and User Conduct

Subscription is for a single individual user only, wherein you will be asked to enter your individual User Name and Password. Therefore, we do not permit any of the following:

• Any other person sharing your User Name and Password. Subscriber is responsible for keeping his or her account password confidential and secured.
• Any part of the Site being cached in proxy servers and accessed by individuals who have not registered with us as users of the Site.
• Access through a single User Name and Password being made available to multiple users on a network.

Subscriber accepts full responsibility for all activities that occur under his/her account. You agree to notify Open Media Network Pvt. Ltd immediately if you suspect any unauthorized use of your account or access to your password. If we reasonably believe that a User Name and Password are being used /misused in any manner as clarified above we reserve the right to cancel access rights immediately without notice, and block access to all users from that IP address. This EMag subscription is for personal use only and may not be used in connection with any commercial endeavors. Illegal and/or unauthorized framing of or linking to the Website, reproduction, selling and republishing are prohibited. Open Media Network Pvt. Ltd. reserves the right to terminate subscription access, in the exercise of our reasonable discretion, based on any activity by a subscriber in violation of these terms You release us from any liability if the software provided to you is not suitable for your existing hardware or software; Contents of this EMag can be printed but cannot be saved or downloaded to another file.

Disclaimer of Warranty

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

• Under no circumstances we will be liable in any way for any content, or its impact on your and/or your business. This includes, but is not limited to, any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, or otherwise transmitted via the E Mag.
• Under no circumstances we would be held responsible for the accuracy or validity of any information it delivers. It is the responsibility of the subscriber to check the truth of any information, claim or statement found on this site, or in the emails it delivers. Sometimes, and despite our best efforts, errors are made. Please understand that we do not promise or guarantee the accuracy or truth or usefulness of any information we send or display.
• we will use reasonable means to ensure that your access to our emag is available 24/7. there will be times when the service is interrupted for maintenance, upgrades and repairs or as a result otelecommunications and equipment failure that are beyond our control. we will do our best to minimize such disruptions where it is within our control. you agree that we will not be liable to you for any modification, suspension, discontinuance or lack of availability of service.
• we make no warranty that our service will meet your requirements and the quality of our products purchased or obtained by you will meet your expectations. emag purchased is on an “as is” and “as available” basis. we expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
• no advice or information, whether oral or written, obtained by you from the company or through or from the service shall create any warranty not expressly stated in these terms.

Termination

Open Media Network Pvt. Ltd, may in its sole discretion, without prior notice and without liability, terminate your account access and password, or use of the Service for any reason, if we believe that you have violated or acted inconsistently with these terms.

Gift Subscription Offer

Specific colours, features and models of the assured free gifts are subject to change depending on availability of the stock with the manufacturer.

OMN shall not be responsible for any product defects or malfunctioning.

OMN will not entertain any request for cancellation of the subscription once the free gift has been dispatched.

OMN shall not be responsible for offered products or service related grievances. Grievances, if any, in this regard must be directly addressed to the concerned manufacturer or sponsor.

Lucky Draw T&C

The lucky draw scheme would be for a limited period only.

The lucky draw winners will be selected through a computerized random process.

Winners will be informed on their registered email ID and mobile number.

Winners will receive the prizes on their registered address only.

All prizes will be awarded on “as is” basis

OMN shall not be responsible for any product defects or malfunctioning.

The prizes are non transferable and are non-encashable.

OMN shall not be responsible for offered products or service related grievances. Grievances, if any, in this regard must be directly addressed to the concerned manufacturer or sponsor.

OMN shall not be liable for any loss or damage whatsoever that maybe suffered, or for any personal injury that maybe suffered, as a result of participating in this offer or using the Prize.

OMN reserves the right to terminate or extend this offer or any part thereof at any time, or to accept or reject or disqualify any or all forms/entry received at their absolute discretion without assigning any reason thereof.
